Mr. Jaramillo, the plaintiff and appellant herein, was defendant in a criminal case wherein he was charged with the crime of robbery. On February 13, 1968, he withdrew his plea of not guilty, entered a plea of guilty, and asked the court to sentence him forthwith. He did not appeal from the judgment and sentence but did on April 2, 1969, petition for a writ of alleging that at the time of his change of plea he was not advised of the consequences of a plea of guilty to the crime with which he was charged.
